City of Muncie: Reached a six figure settlement for a wrongful conviction case against seven police officers and the City for an arrest of the plaintiff for rape based on victim identification during a show-up lineup, ultimately resulting in a guilty verdict and 25 years incarceration of the plaintiff, who was later exonerated through DNA evidence.
Doe et al. v. Starke County: Obtained summary judgment based on qualified immunity for an incident involving the disclosure of the plaintiff’s transgender identity to their spouse during the course of a police investigation and the existence of probable cause for the arrest of the plaintiffs for neglect of a dependent. Currently on appeal in the Seventh Circuit Court of Appeals awaiting a decision.
Brewer v. Starke County: Obtained summary judgment based on Indiana Tort Claims Act immunity for the operation of an E911 system for an incident in which first responders were mistakenly dispatched to the incorrect address, resulting in delayed emergency aid to the plaintiff, who ultimately died.
Clark/Evans v. Bartholomew County: Obtained summary judgment based on Indiana Tort Claims Act immunity for the acts of another for an incident in which County officers were leading a funeral procession and a third party disregarded the funeral procession, causing a car accident and serious bodily injuries to the plaintiffs.
Nazimek v. Town of Schererville: Obtained dismissal of the plaintiff’s complaint based on common law immunity for the failure to provide adequate emergency rescue services for an incident in which it was alleged that EMS responders failed to provide emergency services quickly enough at the scene, ultimately causing the plaintiff’s death later that day.
Calvert v. City of Portland: Caused the plaintiff to voluntarily dismiss their entire complaint for in an incident involving the fatal use of deadly force
Chambers v. Knox County Sheriff’s Department: Obtained dismissal of the plaintiff’s complaint arguing lack of control, Indiana Tort Claims Act immunity, and common law immunity for the death of a young child due to the fatal collision by a vehicle on a state road
Martin v. Noble County Sheriff: Obtained summary judgment that was affirmed on appeal to the Seventh Circuit Court of Appeals based on lack of personal involvement and qualified immunity for an incident involving allegations of excessive force and unreasonable search and seizure of a plaintiff suspected of murder.
