Lisa Baron and Matthew Knight obtained a defense verdict for Defendant, Kosciusko County, in Marshall County Circuit Court on May 13, 2026. The case involved claims that the County was negligent in its construction and maintenance of a culvert installed back in the late 1970s or early 1980s under a county road such that it repeatedly caused a corner of the Plaintiff’s farmland to flood, damaged a fence, and washed away topsoil. The County maintained that it was not negligent in the construction and maintenance of the culvert because the installation of the culvert did not alter the fact that water had been naturally flowing to that corner of the Plaintiff’s property since the 1930s. The case was tried over 2 days, and the jury returned a verdict for the Defendant.
