Favorable Defense Verdict on Damages for Town of Schererville, Indiana

Matthew Knight and Elizabeth Wheaton obtained a favorable defense verdict on behalf of the Town of Schererville, Indiana.  This case was tried on damages with the Town of Schererville admitting that its officer caused the automobile accident while responding to a call.  The plaintiff, a stay-at-home mother with two young children, claimed that she sustained a concussion and on-going post-concussion symptoms, as well as a cervical spinal injury with the radiating pain into her arm and the need for future spinal surgery.  Her husband sought damages for loss of consortium.  The plaintiffs sought $1.2 million in damages at trial.  After the defense presented video evidence of the minor collision and expert testimony that her symptoms were unsupported by medical imaging, the jury returned a favorable award for the defense awarding the plaintiffs approximately $178,500.
